Privacy statement

Version of 27 September 2026. This statement was drawn up for the new website mdn.nl and replaces the statement on denederlanden.eu. It is a translation of the Dutch privacy statement. If the two differ, the Dutch version applies.

1. Who we are

Makelaardij De Nederlanden B.V. processes your personal data. We are located at Bosboom Toussaintstraat 54, 1054 AV Amsterdam, and registered with the Chamber of Commerce under number 34216139. You can reach us on +31 20 589 30 70 and at info@mdn.nl.

We are responsible for processing your data as described in this statement. Our branch De Compagnie in Loenen aan de Vecht and Bussum processes data under its own registration with the Chamber of Commerce, number 30127725.

2. When we process your data

We process personal data when you:

  • request a valuation, an introduction or a viewing
  • instruct us to sell, buy, let, rent, appraise or manage a property
  • register for our property alerts or newsletter
  • contact us by form, email, telephone or WhatsApp
  • are involved in a transaction as a buyer, seller, tenant, landlord or adviser
  • visit our website

3. Which data we process

Depending on the situation, this concerns:

  • name, address, town, email address and telephone number
  • details of the property: address, land registry data, floor area, condition, photographs and documents
  • details of what you are looking for, your search profile and budget
  • data we are required to record under the Dutch Money Laundering and Terrorist Financing (Prevention) Act (Wwft), including a copy or check of your identity document, your citizen service number where it appears on that document, and the source of funds
  • correspondence, notes of conversations and appointments in our system
  • financial data such as bank account number and invoicing details
  • technical data about your visit to the website, as described in our cookie statement

We never ask for more data than the purpose requires. Our forms ask only for name, email address, telephone number and, where relevant, the address of the property.

4. For what purpose and on what legal basis

Where we rely on a legitimate interest, that is our interest in running our business and services properly. We always weigh that interest against your privacy.

5. Who we share data with

We only provide data to others if that is necessary for our services or if the law requires us to. These may be:

  • the NVM and the publisher of funda, for registering and publishing the property and recording the transaction
  • Realworks as the supplier of our estate agency system
  • the Kadaster, via PDOK: the maps on our website are loaded from there, which sends your IP address to the Kadaster. No cookies are placed and the data stays in the Netherlands
  • the notary, valuer, building surveyor, photographer and stylist involved in your file
  • our partners HONK Hypotheekadvies and Brandt & Eskes Verkoopstyling, if you submit a request for their service through our site. They then receive a copy of that request directly
  • the owners association or its managing agent, if the property is part of an owners association
  • the Kadaster, the municipality and other public authorities from which we request information
  • our accountant, our bank and, in the case of an unpaid claim, a debt collection agency or bailiff
  • the suppliers in the table below
  • the Financial Intelligence Unit Netherlands, in the case of a report under the Wwft. We are not allowed to inform you about this.

We conclude a data processing agreement with suppliers who process data on our behalf. We never sell your data.

Vercel and Dropbox are American companies. They are certified under the EU-US Data Privacy Framework, under which the European Commission has found their level of protection adequate. The standard contractual clauses of the European Commission also apply. All other suppliers keep your data within the European Economic Area.

6. How long we keep data

  • Data from a request that does not lead to an instruction: two years after the last contact.
  • Files of completed instructions: seven years after completion, because of the statutory tax retention period and possible liability.
  • Data from client due diligence under the Wwft: five years after the end of the business relationship or after the transaction, as the law requires.
  • Search profiles and registrations for property alerts: until you unsubscribe, and after that no longer than one year.
  • Newsletter: until you unsubscribe.

7. Your rights

You have the right to access your data, to have it corrected or to have it deleted. You can also ask us to restrict processing, object to processing based on a legitimate interest, and ask for the data you provided to us to be transferred. If you have given consent, you may withdraw it at any time. This does not affect the period before.

Please send a request to info@mdn.nl. We respond within one month. To prevent misuse we may ask you to identify yourself. Please note: some data we must keep under the Wwft or tax legislation, even if you ask for it to be deleted.

If you disagree with how we handle your data, please let us know. You can also lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

8. Security

We take appropriate technical and organisational measures. Our website works exclusively over a secure connection, access to our systems is personal and protected with two factor authentication, and only employees who need the data can access it. In the event of a data breach we act according to our internal procedure and report it to the Dutch Data Protection Authority and to you where necessary.

9. Automated decision making

We do not take decisions about you based on automated processing without human involvement.

10. Cookies

Which cookies our website uses and why is described in our cookie statement.

11. Changes

We update this statement when our services or the regulations require it. The current version is always available on mdn.nl. This version is dated 27 September 2026.
